马来西亚社交媒体监管:选择与挑战 (Regulating Social Media in Malaysia: Options and Challenges)

This has in turn triggered legal issues, disputes alleged breach of legal and ethical norms. In order to properly regulate this, the Malaysian government had to resort to some options, starting from encouraging industrial self-regulatory approach, blocking websites and even enforcing criminal and civil sanctions. This paper looks at those attempts that have been taken and that are currently on-going, by looking predominantly on statutory laws, policy initiatives as well as court cases. It is interesting to note that Malaysia has considered each and every option above in the past two decades. Though declaration of no-censorship policy has been repeatedly made out by the Government, yet the more reactive and punitive approaches are currently being increasingly relied on. The paper examines the development of the social media regulation in Malaysia and argues that both self-regulatory and government-led initiatives are necessary in order to ensure the maximum use of the ICT and social media for the benefit of Malaysian society.
