In fact, this principle has been applied by the Islamic jurists for the establishment of their stances on various jurisprudent issues in the ancient and contemporary time. Therefore, this research aims to study the impact of the principle of al-Barāah al-Aṣliyyah on the jurisprudent choices of al-Shaykh al-Bānī, focusing on the issue of purity of the blood. It as well, addresses the argument of al-Shaykh al-Bānī about the stance of majority of Islamic scholars on the impurity of blood. The researcher has reached a conclusion that al-Shaykh al-Bānī’s opinion on the cleanness of the entire bloods except menstrual blood is supported by the authentic prophetic narrations.
