And to clarify its elements, and highlight its applications sample in Saudi Arabia. Also, to show the position of Islamic jurisprudence (Fiqh), and the Saudia regulations, and the opinion of jurists on that. The study was carried by using inductive method to know its rulings in both Islamic law and Civil law. It also uses analytical method to discuss its application in Saudi Arabia. Then, descriptive approach by following the Islamic jurists’ opinion and the constitutional laws on this issue. Then, analyzed those opinions. The study concludes that the Saudia regulations equalize the penalty between the initiator and the subordinate in crime.
